IMPORTANT NOTICE

On July 01, 2001 the Arkansas General Assembly enacted a law which temporarily authorizes the Arkansas State Plant Board to collect a $50.00 Abandoned Pesticide Disposal Fee ( APD Fee) per registered pesticide product per year to fund the activities of the Abandoned Pesticide Advisory Board. This fee is required beginning with 2002 pesticide registrations.

 Contained within that law (Section 5-3) are a number of exemptions which do not require the $50.00 APD Fee.  The following types of product are exempted:

 A) Sanitizers and Disinfectants: i.e. pesticides that are intended to (1) disinfect, sanitize, reduce, or mitigate growth or development of microbiological organisms; or (2) protect inanimate objects (for example floors and walls), industrial processes or systems, surfaces, water, or other chemical substances from contamination, fouling, or deterioration caused by bacteria, viruses, fungi, protozoa, algae, or slime."

 B) Aerosol products which are not labeled for agricultural use

 C) Insect Repellants which are labeled for use on the human body or clothing

 D) Silica Gels and other nonvolatile ready-to-use paste, foam or gel formulations of insect baits

 E) Nonvolatile insecticidal baits in tamper resistant bait stations

 F) Insecticidal flea and tick collars and spot-on flea treatments for dogs and cats

 G) Insecticidal cattle ear tags.

 All other pesticidal products registered with the Arkansas State Plant Board are required to pay the $50.00 APD Fee. This includes spray adjuvants and pesticides exempt from federal registration under FIFRA Section 25(b) which are not included in the above exemptions..

 Registrants must indicate on the Application for Registration of Pesticides (DP-21 Rev. 6/01) that their product is exempted under Section 5-3 in order to avoid paying the APD Fee.

 Registrants who do not indicate an exemption under Section 5-3 are expected to pay the full registration fee and the $50.00 APD Fee.

 Nonexempt pesticides will not be registered/re-registered without the required APD Fee.
